Egham Removals Terms and Conditions
These Terms and Conditions set out the basis on which Egham Removals provides domestic and commercial removal and associated services within the United Kingdom. By placing a booking with Egham Removals, you agree that you have read, understood and accepted these Terms and Conditions. They apply to all services supplied unless otherwise agreed in writing.
1. Definitions
In these Terms and Conditions, the following expressions have the meanings set out below.
Customer means the person, firm or company who requests and purchases services from Egham Removals.
Services means removal, packing, loading, transportation, unloading, unpacking, storage, and any other related services provided by Egham Removals.
Goods means the items, belongings, furniture, personal effects, equipment or other property in respect of which the Services are to be provided.
Contract means the agreement between Egham Removals and the Customer for the provision of Services, incorporating these Terms and Conditions and any written quotation or confirmation issued by Egham Removals.
2. Scope of Services
Egham Removals offers house removals, flat moves, office and commercial relocations, packing and unpacking, furniture handling and related services, generally within Egham and its surrounding areas, and across the wider United Kingdom as agreed.
The exact scope of the Services, including the addresses, dates, times, any storage arrangements, packing requirements and access conditions, will be detailed in the written quotation or booking confirmation. Any Services not expressly stated in the quotation or confirmation are excluded and may incur additional charges if requested.
3. Quotations
All quotations are provided on the basis of the information supplied by the Customer. It is the Customer’s responsibility to ensure that all relevant details are accurate and complete, including inventory, property access, special handling requirements and any restrictions on parking or loading.
Unless stated otherwise, quotations are valid for 30 days from the date of issue and are subject to availability of resources. Egham Removals reserves the right to revise or withdraw a quotation at any time before a booking is confirmed.
Quotations are normally based on factors such as volume or list of items, distance, access conditions, number of operatives, vehicle requirements and time estimates. If any of these details change, or if information provided was incomplete or inaccurate, Egham Removals may amend the price accordingly.
4. Booking Process
A booking is made when the Customer accepts a quotation or proposal from Egham Removals and Egham Removals confirms acceptance of that booking. Confirmation may be given in writing, including electronic communications. Until confirmed, any dates discussed are provisional only and are subject to availability.
Egham Removals may require a deposit or prepayment to secure the booking. Details of any deposit amount and payment deadlines will be notified to the Customer at the time of booking. If the Customer fails to pay the deposit or any required prepayment by the due date, Egham Removals may treat the booking as cancelled by the Customer.
The Customer must check the booking confirmation and immediately notify Egham Removals of any errors or discrepancies. Egham Removals will not be liable for any loss arising from incorrect information that was not reported promptly.
5. Customer Responsibilities
The Customer is responsible for:
Ensuring that adequate and lawful parking and access are available at all relevant properties and locations, including arranging any permits or authorisations required.
Providing clear instructions, directions and contact details for all addresses involved, and ensuring that someone is present at the agreed times to grant access and confirm inventory.
Properly preparing Goods for transport, including securing or removing loose or fragile parts where appropriate, unless packing Services have been specifically requested and agreed.
Ensuring that Goods do not include prohibited, dangerous or illegal items, or items that may cause harm or damage, such as explosives, flammable liquids, gas cylinders, chemicals, drugs or stolen goods.
Declaring any items of exceptional value or fragility in advance, to allow Egham Removals to assess handling requirements and insurance.
6. Payments and Charges
The price for the Services will be as set out in the quotation or booking confirmation, subject to any adjustments in accordance with these Terms and Conditions.
Unless agreed otherwise, payment terms are as follows:
A deposit or part payment may be required at the time of booking.
The balance is normally due on or before the day of the move, and in any event before completion of unloading or the end of the Service.
Egham Removals accepts the payment methods notified at the time of booking. All payments must be made in pounds sterling.
If payment is not received by the due date, Egham Removals may suspend or cancel the Services and may charge interest on overdue sums at the statutory rate or a reasonable commercial rate, from the due date until the date of payment in full.
Additional charges may apply if:
The move involves extra work not originally agreed, such as additional items, dismantling or reassembly of furniture, delays caused by the Customer, or changes in the agreed schedule.
There are unexpected access issues, such as long carry distances, narrow stairways, lack of lifts, or restrictions that were not disclosed in advance.
Waiting time arises due to keys, landlord, agent, or third parties not being ready at the agreed time.
7. Cancellations and Postponements
If the Customer wishes to cancel or postpone a booking, notice must be given as soon as reasonably practicable and confirmed in writing, including electronic communication.
Cancellation or postponement charges may apply as follows, unless agreed otherwise in writing:
If more than 7 days notice before the scheduled move date is given, any deposit paid may be refunded or transferred, subject to reasonable administration costs.
If between 2 and 7 days notice is given, Egham Removals may retain all or part of the deposit, or charge up to 50 percent of the quoted price.
If less than 2 days notice is given, Egham Removals may charge up to 100 percent of the quoted price.
Where Egham Removals cancels the Services (for example due to vehicle breakdown, staff illness, severe weather or circumstances beyond its reasonable control), liability will be limited to a refund of any payments received for the affected Services, or, where possible, re-scheduling of the Services by mutual agreement. Egham Removals will not be liable for indirect or consequential losses arising from such cancellation.
8. Access, Parking and Delays
The Customer must ensure that suitable access and parking arrangements are available for Egham Removals vehicles at the collection and delivery addresses, and at any additional locations involved in the Services. Any parking charges, fines or penalties resulting from inadequate arrangements or incorrect information may be charged to the Customer.
If delays occur due to reasons beyond the control of Egham Removals, such as waiting for keys, third parties not being ready, traffic conditions or access restrictions, Egham Removals reserves the right to charge a reasonable hourly rate for waiting time, in addition to the quoted price.
9. Liability for Loss or Damage
Egham Removals will exercise reasonable care and skill in providing the Services. However, its liability for loss of or damage to Goods is subject to the following provisions.
Egham Removals will not be liable for:
Loss or damage arising from wear and tear, inherent defects, deterioration or fragility of Goods.
Loss or damage to items that are not adequately packed or protected by the Customer, where packing Services were not provided.
Loss or damage involving items of exceptional value, including but not limited to jewellery, watches, precious metals, collections, antiques, fine art, important documents, data, or electronic devices, unless such items were declared in writing and specifically accepted.
Loss, damage or delay caused by war, terrorism, riots, strikes, severe weather, natural disasters, road closures, or other events beyond the reasonable control of Egham Removals.
Egham Removals liability, if any, for loss or damage to Goods, whether caused by negligence, breach of contract or otherwise, shall be limited to a reasonable and proportionate amount, not exceeding the value of the affected item or the overall value declared by the Customer, subject to any applicable insurance terms notified to the Customer.
The Customer is strongly advised to obtain suitable insurance for the move and for Goods in transit or storage. Egham Removals may, where indicated, provide or arrange basic cover, but it remains the Customer’s responsibility to ensure that cover is adequate for their needs.
10. Claims and Complaints
Any loss of or damage to Goods that is visible must be noted on the delivery or completion paperwork at the time of delivery or as soon as reasonably practicable. The Customer should notify Egham Removals of any claim or complaint in writing within 7 days of completion of the Services, providing reasonable details and evidence.
Failure to notify within this period may affect the ability of Egham Removals to investigate and may prejudice any claim. Egham Removals will consider all claims promptly and fairly and may require inspection of the alleged damage, photographs or other supporting information.
11. Excluded Goods
Egham Removals does not accept responsibility for, and may refuse to transport or handle, any of the following categories of items unless expressly agreed in writing in advance:
Valuables such as cash, securities, deeds, bonds or important documents.
Perishable goods, live animals, plants or any items requiring special environmental conditions.
Hazardous materials, including but not limited to explosives, firearms, ammunition, gas bottles, flammable liquids, chemicals, corrosive substances or toxic waste.
If any such items are included without prior agreement, Egham Removals may remove or dispose of them at the Customer’s cost and without liability for any resulting loss.
12. Waste, Disposal and Environmental Regulations
Egham Removals carries out removal and clearance activities in accordance with applicable UK waste and environmental regulations. Where Services include removal of unwanted items, furniture or packaging for disposal or recycling, the following terms apply.
The Customer confirms that they have the right to dispose of any items handed to Egham Removals for clearance. Items will be handled, recycled or disposed of using appropriate and lawful methods, which may include transfer to licensed facilities or charities where practicable.
Certain items may incur additional charges due to special handling or disposal requirements, such as electrical goods, mattresses, construction materials or hazardous waste. These charges will be notified where reasonably foreseeable.
Egham Removals will not collect or dispose of prohibited or hazardous waste in breach of law. If such items are discovered, Egham Removals may refuse to handle them and may charge for any associated costs or delays.
13. Storage Services
Where storage is provided or arranged, Goods will be stored in suitable facilities and reasonable care will be taken to protect them. Storage charges will apply as agreed and are payable in advance or in accordance with the storage invoice or agreement.
If storage charges are not paid when due, Egham Removals may exercise a lien over the Goods and retain possession until all sums owed are paid. In the event of continued non-payment, Egham Removals may, after giving reasonable notice, sell or dispose of Goods to recover outstanding charges and any associated costs.
14. Lien
Egham Removals has a legal right to withhold or ultimately dispose of Goods to recover any overdue charges or expenses owed under the Contract. This lien applies while Goods are in the possession or control of Egham Removals, including in transit or storage.
15. Data Protection
Egham Removals will collect and process personal information about the Customer for the purpose of providing and administering the Services, managing bookings, handling payments, responding to enquiries and complying with legal obligations.
Personal data will be handled in accordance with applicable UK data protection legislation. Egham Removals will take reasonable steps to keep personal data secure and will not share it with third parties except where necessary to perform the Services, meet legal requirements or with the consent of the Customer.
16. Limitation of Liability
Nothing in these Terms and Conditions excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be excluded under UK law.
Subject to this, Egham Removals shall not be liable for any indirect, special or consequential loss, loss of profits, loss of business, loss of opportunity or loss of data arising out of or in connection with the Services, even if advised of the possibility of such losses.
Overall liability of Egham Removals in respect of any single claim or series of connected claims arising from a Contract shall not exceed the total amount paid or payable for the relevant Services, unless otherwise required by law or agreed in writing.
17. Variation
Egham Removals may update or vary these Terms and Conditions from time to time. The version in force at the time of booking will apply to that Contract. Any variation to these Terms and Conditions must be agreed in writing.
18. Severability
If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court or competent authority, the remaining provisions shall remain in full force and effect.
19. Governing Law and Jurisdiction
These Terms and Conditions and any Contract between the Customer and Egham Removals shall be governed by and construed in accordance with the laws of England and Wales.
Any disputes arising out of or in connection with the Services or these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales, without prejudice to any mandatory rights the Customer may have under consumer protection legislation.
By confirming a booking with Egham Removals, the Customer acknowledges that they have read and understood these Terms and Conditions and agree to be bound by them.
